Srikrishna Janmabhoomi case: High Court shakes Muslim party, hearing continues on Hindu party's petition
The Allahabad High Court dismissed the Shahi Idgah Masjid Trust's Order 7, R-11 petition. This is a big blow for the Muslim party. A single bench of Justice Mayank Kumar Jain gave this verdict on Thursday.
In Mathura's Shri Krishna Janmabhoomi case, the Hindu party has won a big legal victory. The Allahabad High Court dismissed the order 7 rule-11 petition of the Shahi Idgah Masjid Trust. A single bench of Justice Mayank Kumar Jain has given this verdict. The decision came on a petition filed by the Muslim party under Order 7 Rule 11 of the CPC.
The Allahabad High Court has considered the Hindu party's petition fit for hearing. Now the trial will go on in the whole matter. The court's decision means that the Hindu party's petitions can be heard in court. The High Court dismissed the petition filed by the Muslim party on the question of maintenance raised by the Hindu party. Earlier, the High Court had reserved the verdict after the hearing was over on June 6. A total of 15 petitions related to Sri Krishna Janmabhoomi and Mathura's Shahi Idgah have been delivered by the court.
The Allahabad High Court heard petitions under Order 7 Rule 11 of the CPC regarding maintenance of a civil suit filed by Bhagwan Shri Krishna Virajman Katra Keshav Dev of Mathura and seven others by the Shahi Idgah Masjid Committee and the Sunni Central Waqf Board. The petitions claimed that the mosque has been constructed on 13.37 acres of land belonging to the Katra Keshav Dev temple.
The Muslim party challenged in the Supreme Court
On December 14, 2023, the Allahabad High Court accepted a petition seeking the formation of an advocate commission for a court-supervised survey of the Shahi Idgah Masjid complex adjacent to the Sri Krishna Janmabhoomi Temple in Mathura. The Muslim party challenged this order of the Allahabad High Court in the Supreme Court. On January 17, 2024, on a petition by the Muslim side, the Supreme Court stayed the Allahabad High Court's order to constitute an advocate commission.
But the Supreme Court made it clear that the hearing of the dispute, including maintainability of the case, would continue before the Allahabad High Court under Order 7 Rule 11 of the CPC. After the Supreme Court's stay order, the Hindu party also filed a petition in the Allahabad High Court seeking a revenue survey. In May 2023, the Allahabad High Court transferred all cases related to the Sri Krishna Janmabhoomi-Shahi Idgah Masjid dispute from the Mathura court to it.
