Can you get maternity leave even without marriage? Know what the rule is

When do you get maternity leave?

Important changes have been made in the Maternity Benefit Bill 2017 under the Labor Act. Pregnant women will now be given leave for 26 weeks i.e. 6 months instead of 12 weeks i.e. 3 months. Its purpose is to provide adequate opportunity for proper safety and care of mother and child after delivery. The biggest thing is that during this period the woman is paid full salary by the company. No deduction can be made in it.

Rule of holiday without marriage

Maternity leave as defined under the Labor Act of the Government of India is legislated equally for married or unmarried women. It does not matter whether the woman is married or unmarried as this law is made only for pregnancy or child care. Therefore, unmarried women will also get 26 weeks maternity leave. There will be no cut in salary during this period.

Keep this in mind

Keep in mind that maternity laws work differently for more than 2 children. Under this, full leave of 26 weeks is given for up to two children, but only 12 weeks i.e. 3 months of maternity leave is given after the delivery of the third child.

These conditions must be met

The employee must have worked for 80 days in the 12 months preceding the delivery. Only then you can get maternity leave. Women who adopt a child will also get the right to take maternity leave. If a woman gives birth to a child under surrogacy, she can also get maternity leave for 26 weeks from the date of handing over the newborn child to its parents.
